The original owner is who has the ability (as far as it goes) in such a matter; so
even if the opportunity to transfer those apps to the second owner was not done
there would be no practical expectation that opportunity should be available to
yet another owner, removed twice from the original offer.

older topics and the ability was discounted. Perhaps they pre-dated this option;
yet still realistically the feature would have expired if not offered to a second owner.
You may be able to contact iTunes Support directly, to ask if the apps would still be
available to you, but the trail is rather cold; most unlikely to be fresh enough to follow.
Usually an iDevice is prepared for re-sale, such as the path described here:

However since you've not contacted Apple in an official capacity here in these threads
your best bet is to ask for clarification should you have reason to expect an exemption.
